These Terms and Conditions govern your use of the Hymac-Direct website and the purchase of goods and services from Hymac-Direct Limited.
By accessing our website or placing an order with us, you agree to these Terms and Conditions.

Throughout these Terms, references to “Hymac-Direct”, “we”, “us” or “our” mean Hymac-Direct Limited.
References to “you”, “your” or “customer” mean the person or organisation purchasing goods or services from us or using our website.
2. About These Terms
These Terms apply to customers purchasing products or services through our website or directly from us.
Please read them carefully before placing an order.
Nothing in these Terms affects any statutory rights you have as a consumer under applicable UK law.
If you are purchasing on behalf of a business, company or other organisation, you confirm that you have authority to bind that organisation to these Terms.
3. Products and Services
Hymac-Direct supplies products and services including, but not limited to:
- Workwear
- Corporate clothing
- Hi-visibility clothing
- PPE and associated products
- Footwear
- Printed garments
- Embroidered garments
- Personalised clothing
- Promotional products
- Signage
- Stickers and labels
- Banners
- Printed merchandise
- Other workwear and business-related products
Products may be manufactured and/or supplied by third-party manufacturers and suppliers.
We reserve the right to change, withdraw or discontinue products without notice.
4. Product Images, Colours and Descriptions
We make reasonable efforts to ensure that product descriptions, specifications, photographs and other information are accurate.
However, images are provided primarily for illustrative purposes.
We cannot guarantee that the colour displayed on your computer, mobile telephone, tablet or other device accurately represents the actual colour of a product.
Colours may also vary slightly between:
- Manufacturers;
- Garment materials;
- Production batches;
- Dye batches;
- Printed products; and
- Embroidered products.
Minor differences in colour, positioning, size or appearance which are normal within the manufacturing, printing or embroidery process will not necessarily mean that the product is defective.
5. Prices
Prices are displayed on our website or provided in our quotations.
Prices may change at any time without notice. Any price change will not normally affect an order already accepted by us unless there has been an obvious pricing error.
Where delivery charges apply, these will be displayed during checkout, included in a quotation or otherwise communicated before the order is completed.
We reserve the right to correct pricing errors.
If an obvious pricing error is discovered after you place an order, we may contact you and give you the option of proceeding at the correct price or cancelling the affected item or order.
6. Orders
Submitting an order does not necessarily mean that we have accepted it.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- A product is unavailable;
- There is an obvious pricing or description error;
- Payment has not been authorised;
- We are unable to fulfil the order;
- We suspect fraudulent activity;
- The order breaches these Terms;
- We are unable to obtain the product from our supplier; or
- The quantity ordered cannot reasonably be supplied.
We may place reasonable restrictions on the quantities of products purchased in a single order.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled goods, subject to any applicable lawful deductions.
7. Payment
Payment must be made using one of the payment methods available through our website or otherwise agreed by us.
Orders will normally not be processed until payment has been successfully authorised unless credit terms have been agreed separately in writing.
You are responsible for ensuring that all payment and billing information provided is accurate and complete.
8. Personalisation, Printing and Embroidery
Customers are responsible for checking all personalisation details supplied to us.
This includes:
- Names;
- Initials;
- Telephone numbers;
- Website addresses;
- Email addresses;
- Logos;
- Colours;
- Sizes;
- Garment locations;
- Print wording;
- Spelling; and
- Other artwork or personalisation instructions.
Where we provide a proof or artwork approval, it is the customer’s responsibility to check it carefully before approving production.
Once a proof has been approved or production has started, changes may not be possible.
If changes are possible after approval, additional charges may apply.
9. Customer-Supplied Artwork, Logos and Intellectual Property
Where you provide us with artwork, logos, photographs, trademarks, names, designs or other material for reproduction, you confirm that you own the material or have all necessary permissions, licences and authority to allow us to reproduce it.
You must not ask us to reproduce material that infringes another person’s or organisation’s copyright, trademark, design right or other intellectual property rights.
We reserve the right to refuse any artwork or personalisation request that we reasonably believe may:
- Infringe intellectual property rights;
- Be unlawful;
- Be fraudulent;
- Contain prohibited material; or
- Expose Hymac-Direct Limited to legal liability.
Where permitted by law, you may be responsible for reasonable losses, costs or claims suffered by Hymac-Direct Limited as a direct result of material you supplied to us without the necessary rights or permissions.
10. Artwork and Design Work Created by Hymac-Direct
Unless otherwise agreed in writing, artwork, layouts, digitised embroidery files, print-ready files, templates or designs created by Hymac-Direct remain our intellectual property until any specifically agreed transfer of rights has taken place.
Payment for printed or embroidered goods does not automatically transfer ownership of production files, embroidery files, templates or artwork created by us.
11. Personalised and Made-to-Order Products
Products personalised or made to the customer’s specification may include:
- Embroidered garments;
- Printed garments;
- Garments carrying names or initials;
- Custom signage;
- Custom banners;
- Stickers;
- Custom printed merchandise; and
- Other bespoke products.
Where permitted by law, the normal consumer right to cancel because you have changed your mind does not apply to goods made to your specifications or clearly personalised.
This does not affect your legal rights if personalised goods are faulty, not as described or otherwise fail to conform to the contract.
Customers should therefore carefully check sizes, quantities, colours, artwork and spelling before approving personalised orders.
12. Direct Delivery from Our Suppliers
Some products sold by Hymac-Direct are stored, processed, fulfilled and/or dispatched directly by third-party manufacturers, distributors or suppliers.
You may therefore receive products in packaging carrying the name or branding of one of our suppliers.
Where an order contains products from different suppliers, your order may arrive in more than one delivery.
Receiving only part of an order does not necessarily mean that products are missing. Remaining products may be dispatched separately.
Unless expressly stated otherwise, your contract for the purchase remains with Hymac-Direct Limited, even where goods are dispatched directly by one of our suppliers.
13. Delivery
Delivery dates and times are estimates unless we expressly agree otherwise.
We will make reasonable efforts to deliver within the estimated timescale but delays may occur due to circumstances outside our reasonable control, including:
- Courier delays;
- Supplier delays;
- Stock shortages;
- Manufacturing delays;
- Severe weather;
- Transport disruption;
- Customs delays;
- Industrial action; or
- Other events beyond our reasonable control.
Where personalised goods are ordered, delivery times normally begin after artwork has been approved and the necessary products are available.
14. Delivery Address
Customers are responsible for supplying a complete and accurate delivery address.
We are not responsible for delays or additional delivery costs caused by incorrect or incomplete delivery information supplied by the customer.
Where goods are returned to us or our supplier because an incorrect address was provided or delivery could not reasonably be completed, an additional delivery charge may apply before goods are re-dispatched.
15. Risk and Ownership
Responsibility for goods passes in accordance with applicable law and the delivery arrangements for the order.
Where goods are sold to a business customer on agreed credit terms, ownership of the goods may remain with Hymac-Direct Limited until payment has been received in full, to the extent permitted by law.
16. Consumer Cancellation Rights
If you are purchasing as a consumer, you may have a legal right to cancel certain online purchases within 14 days of receiving the goods.
Where that right applies, you must inform us clearly that you wish to cancel.
The right to cancel does not normally apply to goods that have been made to your specifications or clearly personalised.
Other statutory exceptions may also apply.
Nothing in this section affects your rights in relation to faulty or misdescribed goods.
17. Returns
Before returning goods, please contact Hymac-Direct and follow our returns procedure.
Goods being returned because you have changed your mind should normally be:
- Unused;
- Unworn;
- Unwashed;
- In a resaleable condition; and
- Returned with appropriate original packaging where reasonably possible.
Where a consumer exercises a statutory cancellation right, any deduction from a refund for diminished value will only be made where permitted by law.
Personalised or made-to-order goods cannot normally be returned simply because you have changed your mind.
This does not affect your statutory rights.
18. Return Delivery Costs
Where goods are faulty, damaged, incorrectly supplied or otherwise do not conform to the contract, we will deal with reasonable return costs in accordance with applicable law.
Where a customer simply changes their mind and has a legal right to cancel, the customer may be responsible for the cost of returning the goods where permitted by law and where they have been appropriately informed of that responsibility.
19. Faulty, Damaged or Incorrect Goods
Please contact us as soon as reasonably possible if goods arrive damaged, faulty or incorrect.
Where appropriate, we may ask you to provide photographs or other reasonable information so that we can investigate the issue.
Depending on the circumstances and your statutory rights, we may offer:
- Repair;
- Replacement;
- Re-performance of a service;
- Price reduction; or
- Refund.
Nothing in these Terms limits your statutory rights regarding faulty, misdescribed or unsatisfactory goods.
20. Garment Sizes
Garment sizing can vary between brands, manufacturers and styles.
Customers should check the relevant sizing information before ordering.
A stated size such as Small, Medium, Large or XL may not have identical measurements across different manufacturers.
Where a garment has been personalised, we cannot normally accept a return merely because the customer selected an incorrect size, unless the goods are faulty or incorrectly supplied.
21. Stock Availability
Products displayed on our website are subject to availability.
Stock information can change quickly, particularly where products are supplied by third-party warehouses.
If a product becomes unavailable after you place an order, we may:
- Offer a suitable alternative;
- Place the product on back order where appropriate;
- Refund the unavailable product; or
- Cancel the affected part of the order.
We will not substitute a materially different product without your agreement where your agreement is required.
22. Third-Party Websites and Services
Our website may contain links to third-party websites or use third-party services.
We are not responsible for the content, security, availability or privacy practices of independent third-party websites.
Customers should review the applicable terms and privacy policies before using third-party services.
23. Website Use
You must not use our website:
- For unlawful purposes;
- To commit or encourage fraud;
- To infringe our intellectual property rights or those of another party;
- To upload or transmit viruses or malicious software;
- To attempt unauthorised access to our systems;
- To interfere with the security or operation of our website;
- To scrape or harvest information unlawfully;
- To collect personal information about other users unlawfully;
- To send spam, phishing communications or malicious content;
- To impersonate another person;
- To submit deliberately false or misleading information; or
- In any other manner that violates applicable law.
We may restrict or terminate access to our website where we reasonably believe these Terms have been breached.
24. Our Intellectual Property
Unless otherwise stated, the content of our website, including our branding, text, graphics, designs and original images, belongs to Hymac-Direct Limited or is used by us with permission.
You may not reproduce, copy, distribute, commercially exploit or otherwise use our protected content without permission except where permitted by law.
Third-party product names, logos and trademarks remain the property of their respective owners.
25. Website Accuracy
We make reasonable efforts to keep information on our website accurate and current.
However, occasional errors may occur in relation to:
- Product descriptions;
- Specifications;
- Prices;
- Images;
- Promotions;
- Delivery charges;
- Stock availability; or
- Delivery estimates.
We reserve the right to correct errors and update information.
Where an error materially affects an order you have already placed, we will deal with the order in accordance with applicable law and these Terms.
26. Business Customers
If you purchase goods wholly or mainly for business purposes, you are treated as a business customer rather than a consumer.
Certain consumer rights, including some cancellation rights, do not apply to business-to-business transactions.
Any quotation, credit account, trade pricing or separately agreed written commercial terms may supplement these Terms.
If separately agreed written terms conflict with these Terms, the specifically agreed written terms will normally take precedence to the extent of that conflict.
27. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
For consumers, nothing in these Terms excludes or restricts your statutory rights.
For business customers, to the extent permitted by law, Hymac-Direct Limited will not be liable for indirect or consequential business losses, loss of profits, loss of business, loss of opportunity or loss of anticipated savings arising from a purchase or use of our website.
Any other limitation of liability will apply only to the extent permitted by applicable law.
28. Events Outside Our Control
We will not be responsible for a failure or delay in performing our obligations where that failure or delay is caused by circumstances outside our reasonable control.
Such circumstances may include severe weather, fire, flood, industrial disputes, transport disruption, supplier failure, courier disruption, government action, war, civil disturbance, telecommunications failure or other events beyond our reasonable control.
This provision does not affect rights that cannot legally be excluded.
29. Personal Information
We process personal information in accordance with our Privacy Policy and applicable data protection legislation.
Customers should review our Privacy Policy for information about how personal information is collected, used, stored and protected.
30. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, website, products, services or legal requirements.
The latest version will be made available through our website.
Changes will not retrospectively remove rights that have already arisen under an existing contract.
31. Severability
If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue in effect.
32. No Waiver
If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.
33. Entire Agreement – Business Customers
For business customers, these Terms together with the relevant order, quotation and any expressly agreed written terms constitute the agreement between the parties in relation to the relevant purchase.
Nothing in this section excludes liability for fraud or fraudulent misrepresentation.
34. Governing Law and Jurisdiction
These Terms and any contract between you and Hymac-Direct Limited are governed by the laws of England and Wales.
If you are a consumer, you may also have mandatory legal rights in the part of the United Kingdom in which you live, and nothing in these Terms removes those rights.
For business customers, the courts of England and Wales will have jurisdiction in relation to disputes arising from these Terms or a contract with us, unless otherwise agreed in writing.
